Ahmed ed-Des\u00fbk\u012b, s. 343-344).<\/p>\n<p>Her ne kadar \u0130sl\u00e2m tarihinde \u015eeyb\u00e2n\u00ee\u2019den \u00f6nce devletler hukuku konular\u0131n\u0131 kapsayacak bir i\u00e7erikle \u201csiyer\u201d terimi kullan\u0131lm\u0131\u015f ve baz\u0131 y\u00f6nleri ayn\u0131 isimle kitapla\u015ft\u0131r\u0131lm\u0131\u015fsa da (bk. S\u0130YER) onun bu eseri, konunun b\u00fct\u00fcn boyutlar\u0131n\u0131 ku\u015fatmas\u0131 ve sistematik bir tarzda ele almas\u0131 dolay\u0131s\u0131yla sadece f\u0131k\u0131h de\u011fil genel hukuk tarihinde de bir ilktir. es-Siyer\u00fc\u2019l-keb\u00eer, bu alan\u0131n ilk m\u00fcellifi olarak takdim edilen Eb\u00fb Han\u00eefe\u2019nin (\u015eeyb\u00e2n\u00ee, Kit\u00e2b\u00fc\u2019s-Siyer, ne\u015fredenin giri\u015fi, s. 38, 55, 68; \u0130bn Hacer el-Askal\u00e2n\u00ee, s. 153; Muhammed Ham\u00eedullah, s. 43, 65; Kruse, JPHS, III\/4 [1955], s. 243) devletler hukukuna ili\u015fkin ictihadlar\u0131n\u0131 b\u00fcy\u00fck \u00f6l\u00e7\u00fcde yans\u0131t\u0131r. Yine \u015eeyb\u00e2n\u00ee\u2019ye nisbet edilen es-Siyer\u00fc\u2019s-sa\u0121\u012br de esasen Eb\u00fb Han\u00eefe\u2019nin siyer k\u00fclt\u00fcr\u00fcn\u00fc yans\u0131tan, hatta baz\u0131 yorumlara g\u00f6re bizzat ondan rivayet edilen bir eserdir (Eb\u00fb Y\u00fbsuf, ne\u015fredenin giri\u015fi, s. 4; M. Z\u00e2hid Kevser\u00ee, s. 62; M. Eb\u00fb Zehre, s. 241). Serahs\u00ee\u2019nin ifadelerinden anla\u015f\u0131ld\u0131\u011f\u0131 kadar\u0131yla es-Siyer\u00fc\u2019s-sa\u0121\u012br onun el-Mebs\u00fb\u1e6d isimli geni\u015f eserinin \u201cKit\u00e2b\u00fc\u2019s-Siyer\u201d b\u00f6l\u00fcm\u00fcnde \u015ferhedilmi\u015ftir (el-Mebs\u00fb\u1e6d, X, 144).<\/p>\n<p>Hocas\u0131 Eb\u00fb Han\u00eefe\u2019nin ictihadlar\u0131ndan Eb\u00fb Y\u00fbsuf kanal\u0131yla ula\u015ft\u0131klar\u0131n\u0131 \u201ces-sag\u012br\u201d diye nitelenen kitaplar\u0131nda, herhangi bir arac\u0131 olmaks\u0131z\u0131n do\u011frudan Eb\u00fb Han\u00eefe\u2019den ald\u0131\u011f\u0131 h\u00fck\u00fcmleri ise \u201cel-keb\u00eer\u201d diye an\u0131lan eserlerinde derledi\u011fini dile getiren yoruma g\u00f6re (\u0130bn \u00c2bid\u00een, I, 16, 19) \u015eeyb\u00e2n\u00ee es-Siyer\u00fc\u2019l-keb\u00eer\u2019i do\u011frudan Eb\u00fb Han\u00eefe\u2019den alm\u0131\u015ft\u0131r. Fakat \u015eeyb\u00e2n\u00ee\u2019nin Eb\u00fb Y\u00fbsuf arac\u0131l\u0131\u011f\u0131yla haz\u0131rlad\u0131\u011f\u0131 el-A\u1e63l (el-Mebs\u00fb\u1e6d) ve el-\u00c2s\u0331\u00e2r\u2019\u0131 \u201csag\u012br\u201d diye nitelememesi bu yorumu zay\u0131flatmaktad\u0131r. Di\u011fer taraftan Hat\u00eeb el-Ba\u011fd\u00e2d\u00ee\u2019nin verdi\u011fi bilgiye g\u00f6re \u015eeyb\u00e2n\u00ee\u2019nin eserleri i\u00e7inde sadece el-C\u00e2mi\u02bfu\u2019\u1e63-\u1e63a\u0121\u012br\u2019de Eb\u00fb Y\u00fbsuf\u2019un tesiri olmu\u015f, di\u011ferleri do\u011frudan kendi kaleminden \u00e7\u0131km\u0131\u015ft\u0131r (T\u00e2r\u00ee\u1e2bu Ba\u0121d\u00e2d, II, 180). \u00d6yle anla\u015f\u0131l\u0131yor ki \u015eeyb\u00e2n\u00ee eserlerini \u00e2deta iki defa yaz\u0131yor, \u00f6nce kaleme ald\u0131\u011f\u0131 nisbeten k\u00fc\u00e7\u00fck hacimli olanlar\u0131n\u0131 daha sonra tekrar g\u00f6zden ge\u00e7iriyor ve il\u00e2velerle geli\u015ftiriyordu (Serahs\u00ee, el-Mebs\u00fb\u1e6d, XXX, 287; kr\u015f. Muhammed b. Hasan e\u015f-\u015eeyb\u00e2n\u00ee, ne\u015fredenin giri\u015fi, s. 57). Buna g\u00f6re Eb\u00fb Han\u00eefe\u2019nin kontrol\u00fc alt\u0131nda es-Siyer\u00fc\u2019\u1e63-\u1e63a\u0121\u012br\u2019i yazm\u0131\u015f, Evz\u00e2\u00ee bunu tenkit amac\u0131yla Siyer\u00fc\u2019l-Evz\u00e2\u02bf\u00ee\u2019yi haz\u0131rlam\u0131\u015f, Eb\u00fb Y\u00fbsuf er-Red \u02bfal\u00e2 Siyeri\u2019l-Evz\u00e2\u02bf\u00ee ile bu ele\u015ftirilere cevap vermi\u015f, b\u00fct\u00fcn bu tart\u0131\u015fmalarla birlikte Hanef\u00ee mezhebinin siyer merkezli bak\u0131\u015f a\u00e7\u0131s\u0131n\u0131 etrafl\u0131ca yans\u0131tmak amac\u0131yla \u00e7ok sonralar\u0131 \u015eeyb\u00e2n\u00ee taraf\u0131ndan es-Siyer\u00fc\u2019l-keb\u00eer telif edilmi\u015ftir. Eseri \u015ferheden Serahs\u00ee dahil olmak \u00fczere \u00e7e\u015fitli kaynaklarda \u015eeyb\u00e2n\u00ee\u2019nin, es-Siyer\u00fc\u2019\u1e63-\u1e63a\u0121\u012br\u2019ini inceleyen Evz\u00e2\u00ee\u2019nin kendisini k\u00fc\u00e7\u00fcmseyici bir tav\u0131r tak\u0131nmas\u0131 \u00fczerine es-Siyer\u00fc\u2019l-keb\u00eer\u2019i yazd\u0131\u011f\u0131 ve h\u00fck\u00fcmleri hadis rivayetleriyle temellendirdi\u011fi i\u00e7in bu defa Evz\u00e2\u00ee\u2019nin takdirine mazhar oldu\u011funa dair bilgi (\u015eer\u1e25u\u2019s-Siyeri\u2019l-keb\u00eer, I, 3) Evz\u00e2\u00ee\u2019nin vefat tarihi (157\/774) ve eserin telif zaman\u0131 g\u00f6z \u00f6n\u00fcne al\u0131nd\u0131\u011f\u0131nda \u015f\u00fcpheli g\u00f6r\u00fcnmektedir. Zira es-Siyer\u00fc\u2019l-keb\u00eer onun 180 (796) veya 187 (803) y\u0131l\u0131nda tayin edildi\u011fi Rakka kad\u0131l\u0131\u011f\u0131 s\u0131ras\u0131nda yaz\u0131lm\u0131\u015ft\u0131r. Bu kitab\u0131n \u015eeyb\u00e2n\u00ee\u2019nin kaleme ald\u0131\u011f\u0131 en son eser oldu\u011funu g\u00f6steren bir ba\u015fka delil de es-Siyer\u00fc\u2019l-keb\u00eer\u2019in, onun di\u011fer b\u00fct\u00fcn eserlerini rivayet edenler aras\u0131nda yer alan Eb\u00fb Hafs el-Keb\u00eer Ahmed b. Hafs taraf\u0131ndan rivayet edilmemi\u015f olmas\u0131d\u0131r (Ke\u015ff\u00fc\u2019\u1e93-\u1e93un\u00fbn, II, 1014; \u0130bn \u00c2bid\u00een, I, 17). \u00c7\u00fcnk\u00fc Eb\u00fb Hafs, hocas\u0131 \u015eeyb\u00e2n\u00ee\u2019nin son y\u0131llar\u0131nda Ba\u011fdat\u2019tan ayr\u0131lm\u0131\u015f oldu\u011fu i\u00e7in kitab\u0131n yaz\u0131m\u0131na \u015fahit olmam\u0131\u015ft\u0131 (Heffening, s. 160; M. Eb\u00fb Zehre, s. 241-242; Muhammed el-Hudar\u00ee, s. 172, 220). Altm\u0131\u015f ayr\u0131 defter halinde yaz\u0131lan eser m\u00fcellifi taraf\u0131ndan Halife H\u00e2r\u00fbn\u00fcrre\u015f\u00eed\u2019e takdim edilmi\u015f, o zamana kadar b\u00f6yle bir eser haz\u0131rlanmad\u0131\u011f\u0131 i\u00e7in takdirlerini belirten halife, bizzat m\u00fcellifinden okumalar\u0131n\u0131 sa\u011flamak \u00fczere o\u011fullar\u0131 Em\u00een ile Me\u2019m\u00fbn\u2019u ona g\u00f6ndermi\u015ftir.<\/p>\n<p>Eser a\u011f\u0131rl\u0131kl\u0131 olarak devletler umumi hukuku kapsam\u0131na giren konular\u0131 ihtiva etmektedir. Bu \u00e7er\u00e7evede s\u0131n\u0131r boylar\u0131nda ikamet etmenin ve serhadde askerlik yapman\u0131n faziletine ili\u015fkin rivayet ve yorumlarla ba\u015flayan kitap ordu kumandanlar\u0131n\u0131n uymas\u0131 gereken kurallar\u0131, asker sevketmenin esaslar\u0131n\u0131, bayrak ve flama kullan\u0131m\u0131n\u0131, sava\u015fa fiilen ba\u015flamadan \u00f6nce d\u00fc\u015fmana \u0130sl\u00e2m ve bar\u0131\u015f \u00e7a\u011fr\u0131s\u0131nda bulunmay\u0131, sava\u015f s\u0131ras\u0131nda ge\u00e7erli olacak strateji ve h\u00fck\u00fcmleri, eman ve diplomatik ili\u015fkileri, fey-ganimet ve esirlere dair h\u00fck\u00fcmleri, milletleraras\u0131 tahkim ve anla\u015fmalar\u0131 ele almaktad\u0131r. Bununla birlikte yer yer yabanc\u0131lar hukuku, kanunlar ihtil\u00e2f\u0131 ve vatanda\u015fl\u0131k hukukunu ilgilendiren ayr\u0131nt\u0131lara da giren eser bu \u00f6zelli\u011fiyle k\u0131smen devletler hususi hukuku konular\u0131n\u0131 da i\u00e7ermektedir. Ayr\u0131ca kitapta irtidad, \u00f6\u015f\u00fcr ve cizye gibi siyer gelene\u011fine \u00f6zg\u00fc konulara de\u011finilmekte, devletler hukukuyla do\u011frudan ilgisi bulunmayan baz\u0131 konular\u0131n da m\u00fcstakil ba\u015fl\u0131klar alt\u0131nda incelendi\u011fi g\u00f6r\u00fclmektedir.<\/p>\n<p>\u015eeyb\u00e2n\u00ee\u2019nin z\u00e2hir\u00fc\u2019r-riv\u00e2ye eserleri i\u00e7inde en fazla hadis, eser ve sah\u00e2b\u00ee kavli ihtiva edeni es-Siyer\u00fc\u2019l-keb\u00eer\u2019dir. Onun di\u011fer f\u0131k\u0131h eserlerine nisbetle burada rivayet malzemesine \u00f6zel \u00f6nem vermesi siyer alan\u0131n\u0131n kendi i\u00e7 \u00f6zelli\u011fi ve kaynaklar\u0131yla ilgili bir husustur. Gayri m\u00fcslim toplumlarla ili\u015fkilerde takip edilecek siyas\u00ee ve hukuk\u00ee \u00e7er\u00e7eve \u00f6zellikle Hz. Muhammed\u2019in ve onun ard\u0131ndan Hulef\u00e2-yi R\u00e2\u015fid\u00een\u2019in takip etti\u011fi yoldan \u00e7\u0131kar\u0131ld\u0131\u011f\u0131 i\u00e7in bu alanda rivayet malzemesi \u00f6zel bir \u00f6nem ta\u015f\u0131maktad\u0131r. Di\u011fer taraftan haz\u0131rlad\u0131\u011f\u0131 kitab\u0131n devletler hukuku alan\u0131ndaki ilk kapsaml\u0131 eser h\u00fcviyetini ta\u015f\u0131yaca\u011f\u0131n\u0131n bilincinde olan ve Irakl\u0131lar\u2019a y\u00f6neltilen \u00f6nceki ele\u015ftirileri hesaba katan \u015eeyb\u00e2n\u00ee\u2019nin burada yer verdi\u011fi h\u00fck\u00fcmleri delillendirme kayg\u0131s\u0131n\u0131 ta\u015f\u0131d\u0131\u011f\u0131 sezilmektedir.<\/p>\n<p>es-Siyer\u00fc\u2019l-keb\u00eer\u2019de Hanef\u00ee mezhebinin d\u0131\u015f\u0131nda di\u011fer baz\u0131 mezhep g\u00f6r\u00fc\u015flerine ve onlar\u0131n delillerine de yer verildi\u011fi tesbitiyle Irak, Hicaz ve \u015eam merkezli yakla\u015f\u0131mlar\u0131 mukayese eden m\u00fcellifin bunlardan ikisinin birle\u015fti\u011fi g\u00f6r\u00fc\u015f\u00fc tek ba\u015f\u0131na kalan ictihada tercih etti\u011fi bilgisi (Nec\u00eeb el-Ermen\u00e2z\u00ee, s. 45) tenkide a\u00e7\u0131kt\u0131r. Fukah\u00e2dan Cedel ilmine d\u00e2ir ilk kitab tasnif eden z\u00e2t Kaff\u00e2l-i Keb\u00eer\u2019dir.<\/p>\n<p>Bu z\u00e2t, \u0130sl\u00e2miyyet\u2019e hem kalemiyle, hem de k\u0131l\u0131c\u0131 ile hizmet etmi\u015ftir. Pek bed\u00ee\u2019 yaz\u0131lar\u0131, muhte\u015fem kasideleri vard\u0131r.
